BigToe Pose, Inc. and its affiliates (“Company,” “our,” “we,” or “us”) provide this Privacy Policy (“Policy”) to explain how we collect, use, and disclose information. This Policy applies to information that we collect from our clients in connection with our mobile applications and software, including email and Internet services, as well as information we collect from visitors and users of our websites and mobile applications (collectively, the “Services”).
By accessing or using the Services or otherwise agreeing to this Policy, you consent to the collection, use, disclosure and other handling of your information as described below.
As used herein, “Personal Information” means information that, alone or when in combination with other information, may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.
WE COLLECT YOUR INFORMATION
We collect Personal Information when you:
- register to use the Services;
- log in with social networking credentials;
- use the Services; and
- communicate with us.
We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Services
Personal Information Collection. You must register to use the Services. To register, you may need to provide Personal Information, such as your name, email address and physical or postal address. You may also provide other optional information.
Social Sign-On. We collect Personal Information from the social media website when you use your social media credentials to log into the Services. For example, when you log in with your Facebook credentials, we may collect the Personal Information you have made publicly available in Facebook, such as your name, gender, age, and profile picture.
Using the Services. We collect information you post through the Services. For example, when you interact with other users by using our mobile applications or websites, the Services will collect the information you provide in such submissions, including any Personal Information.
Making Payments. When you make payments through the Services, you may need to provide Personal Information to our third-party payment solutions providers (including, without limitation, Stripe), such as your credit card or debit card number and billing address.
Customer Support. We may collect Personal Information through your communications with our customer-support team.
Location Information from Your Mobile Device. We may collect and store your location information if you enable your mobile device to send it to us. Collection of this information may improve the provision of the Services.
Cookies, Automatic Data Collection, and Related Technologies. The Services collect and store information that is generated automatically as you use it, including your preferences and anonymous usage statistics.
When you visit the Services, we and our third-party service providers receive and record information on our server logs from your browser, including your Internet Protocol address, and from cookies and similar technology. Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly.
By using the Services, you are authorizing us to gather, parse, and retain data related to the provision of the Services.
HOW WE USE YOUR INFORMATION
We use Personal Information in the following ways:
- To identify you and your account and to enable you to register to use the Services;
- To provide our websites and mobile applications and their content to you and to enhance users’ experience;
- To provide and facilitate the Services, including by providing Personal Information to third parties, including, without limitation, to yoga and fitness instructors, to allow us to provide and facilitate the Services;
- To enable registration in yoga and other fitness courses and classes;
- To respond to your communications and to send you information that you request or agree to receive, via regular or electronic mail, text message, or other marketing channels;
- To notify you about changes to the Services or practices;
- To improve the functionality of the Services, customer service and for other internal business purposes such as account management or system maintenance;
- To monitor the Services for security purposes;
- To display content to you, including advertisements, on social media channels (e.g., Facebook, Twitter, LinkedIn, etc.); and
- To send you advertisements or other marketing materials via email, text message or other marketing channels about other programs, promotions or services (or those of our affiliates), that we think may be of interest to you if you have requested or agreed to receive such information, or where we are otherwise permitted by local law to contact you for these purposes.
Anonymous and Aggregate Data. Personal Information does not include anonymous or aggregate statistical information or data that does not allow a third party to identify a specific individual. We reserve the right to use anonymous or aggregate data for any purpose, including, but not limited to, improving the content of the Services and the functionality of the Services, marketing, and analyzing the use of the Services. We may also disclose such anonymous aggregate information to our partners or third-party service providers, excluding any Personal Information, except as otherwise provided in this Policy.
HOW WE MAY SHARE YOUR INFORMATION
We Use Vendors and Third-Party Service Providers. We may share any information we receive, including your Personal Information, with vendors and third-party service providers retained in connection with the provision of the Services. These third parties may have their own privacy policies.
Displaying to Other Users. Some content that you post to the Services may be displayed publicly. Other users of the Services may be able to see some information about you, such as information contained in the information that you post. You should exercise caution when using public forums. We discourage the posting of sensitive or Personal Information in comments or posts to the Services and we are not responsible for the use of any Personal Information by third parties that you publicly post on the Services.
Social Networking and Other Websites. The Services may allow you to post information to social networking websites, such as Facebook. We do not share your information with such social networking websites unless you direct the Services to share it. The use of the information by such social networking websites will be governed by their privacy policies, and we do not control their use of the shared data.
Your Employer. We may disclose information to your employer (or similar entity), if you participate in any of enterprise solutions or corporate programs.
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, usage information and device identifier (including IP address), and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order, warrant or subpoena; respond to your requests; enforce our Services, or other applicable policies; or protect yours, ours or others’ rights, property, or safety. Unless prohibited by law or court order, or unless we determine in our sole discretion that notification is inappropriate under the circumstances, we will take all reasonable steps to notify all affected users of the request for information or intended disclosure prior to disclosure.
Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information, including Personal Information, may be sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information.
With Your Consent. We may also disclose your information, including your Personal Information, where you have specifically provided your consent for the disclosure.
CALIFORNIA RESIDENTS
California residents who have an established business relationship with us may choose to opt out from our sharing Personal Information with third parties for direct marketing purposes. SECURITY OF YOUR INFORMATION
We take steps to ensure that your information is treated securely and in accordance with this Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.
By using the Services or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Services or sending an e-mail to you. You may have a legal right to receive this notice in writing. CHILDREN’S PRIVACY
We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age, and no part of the Service is directed to children under the age of 13. If you learn that your child has provided us with Personal Information without your consent, you may alert us at info@bigtoe.yoga. If we learn that we have collected any Personal Information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.
INTERNATIONAL USERS
The Services are operated in the United States. If you are located outside of the United States, please be aware that the information we collect about you, including Personal Information, will be transferred to the United States. By using the Services, you consent to the transfer, processing and storage of your information, including Personal Information, in the United States in accordance with this Policy.

New Uses of Personal Information. From time to time, we may desire to use Personal Information for uses not previously disclosed in our Policy.
