This Policy applies to information that we collect from clients, providers, visitors, and users in connection with our websites, mobile applications, web applications, software, email, Internet services, and related services (collectively, the “Services”).

This Policy describes how we collect, use, disclose, and otherwise process information in connection with the Services. As used herein, “Personal Information” means information that, alone or when in combination with other information, may be used to readily identify, contact, or locate you, such as name, address, email address, or phone number. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

For example, when you log in with your Facebook credentials, we may collect Personal Information you have made available through Facebook, such as your name, gender, age, and profile picture, depending on your settings and the permissions you grant.

Using the Services. We collect information you provide through the Services. For example, when you interact with other users, book or request services, complete forms, submit preferences, or communicate through our mobile applications, websites, or web applications, the Services may collect the information you provide in such submissions, including any Personal Information.

Making Payments. When you make payments through the Services, you may need to provide Personal Information to our third-party payment solutions providers, including, without limitation, Stripe. This may include payment card information, billing address, and related transaction information. We do not directly store complete payment card numbers unless expressly stated otherwise.

Collection of this information may improve the provision of the Services.

Cookies, Automatic Data Collection, and Related Technologies. The Services collect and store information that is generated automatically as you use them, including your preferences, device and browser information, usage data, and interactions with our websites and web app.

When you visit the Services, we and our service providers may receive and record information from your browser or device, including your Internet Protocol address, device identifiers, browser type, operating system, referring URLs, pages viewed, links clicked, and other information about your interactions with the Services. We may collect this information through cookies, pixels, tags, server logs, server-side tagging, conversion APIs, and similar technologies.

These partners may process information collected through cookies, pixels, tags, and similar technologies, subject to applicable law and any privacy choices made available through the Services.

We may use advertising measurement tools, including enhanced conversion or similar tools, that use customer-provided information such as an email address or phone number to help measure advertising performance. Where used, this information is intended to be processed in a privacy-protective manner, such as through hashing, and subject to applicable law.

Where available, our cookie preference tools allow you to save choices related to certain categories of cookies and similar technologies. The availability and effect of these controls may vary based on your browser, device, and our site configuration.

You can also control cookies through your browser settings. If you block or delete cookies, some features of the Services may not work properly.

Anonymous and Aggregate Data. Personal Information does not include anonymous or aggregate statistical information or data that does not allow a third party to identify a specific individual. We reserve the right to use anonymous or aggregate data for any purpose, including, but not limited to, improving the content of the Services, improving the functionality of the Services, marketing, and analyzing the use of the Services. We may also disclose such anonymous or aggregate information to our partners or third-party service providers, excluding any Personal Information, except as otherwise provided in this Policy.

How we may share your information

We Use Vendors and Third-Party Service Providers. We may share information we receive, including Personal Information, with vendors and third-party service providers retained in connection with the provision, operation, security, analytics, advertising, measurement, payment processing, support, and improvement of the Services. These third parties may have their own privacy policies.

Advertising, Analytics, and Measurement Partners. We may share or make available certain information with advertising, analytics, and measurement partners through cookies, pixels, tags, server-side tracking, conversion APIs, and similar technologies. This may help us measure advertising performance, understand how users interact with the Services, attribute visits, signups, and bookings to advertising campaigns, and improve our marketing. These activities may be considered a “sale,” “sharing,” or targeted advertising under some privacy laws.

Displaying to Other Users. Some content that you post to the Services may be displayed publicly or to other users involved in the provision or receipt of services. Other users of the Services may be able to see certain information about you, such as information contained in the information that you post or submit. You should exercise caution when using public forums. We discourage the posting of sensitive or Personal Information in comments or public posts to the Services, and we are not responsible for the use of any Personal Information by third parties that you publicly post on the Services.

Social Networking and Other Websites. The Services may allow you to post information to social networking websites, such as Facebook. We do not share your information with such social networking websites unless you direct the Services to share it or unless sharing occurs through advertising, analytics, measurement, or similar technologies described in this Policy. The use of the information by such social networking websites will be governed by their privacy policies, and we do not control their use of the shared data.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Your Employer. We may disclose information to your employer or a similar entity if you participate in any enterprise solutions, workplace wellness offerings, corporate programs, or employer-funded services.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, usage information and device identifiers, including IP address, and content if we believe doing so is required or appropriate to comply with law enforcement requests and legal process, such as a court order, warrant, or subpoena; respond to your requests; enforce our Services or other applicable policies; or protect yours, ours, or others’ rights, property, or safety. Unless prohibited by law or court order, or unless we determine in our sole discretion that notification is inappropriate under the circumstances, we will take reasonable steps to notify affected users of the request for information or intended disclosure prior to disclosure.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information, including Personal Information, may be sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information.

With Your Consent. We may also disclose your information, including your Personal Information, where you have specifically provided your consent for the disclosure.

California residents

California residents may have certain privacy rights under applicable California law, which may include the right to request access to, correction of, or deletion of Personal Information, and the right to opt out of certain uses or disclosures of Personal Information for targeted advertising where applicable.

We may use third-party advertising and analytics technologies that could be considered a “sale,” “sharing,” or use of Personal Information for targeted advertising under some privacy laws. To submit a California privacy request, including an opt-out request, please email info@bigtoe.yoga with “Privacy Policy – California” in the subject line.

Some browsers and browser extensions may transmit opt-out preference signals, such as Global Privacy Control. Where required by applicable law, we treat Global Privacy Control signals as requests to opt out of the sale or sharing of Personal Information for targeted advertising.

Some browsers offer “Do Not Track” settings. Because there is not yet a common industry or legal standard for responding to those settings, our Services do not currently respond to “Do Not Track” signals.

New Uses of Personal Information. From time to time, we may desire to use Personal Information for uses not previously disclosed in our Policy.
